By purchasing, booking, or engaging any service offered by Charlotte Beswick, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms and Conditions. These terms form a legally binding contract under the laws of Western Australia and the Commonwealth of Australia.

1.1 These Terms and Conditions ("Terms") govern the relationship between Charlotte Beswick ABN 80 901 748 495 ("Charlotte Beswick," "we," "us," or "our") and any individual or entity ("Client," "you," or "your") who purchases, books, or participates in any service, program, product, or event offered by Charlotte Beswick.
1.2 These Terms apply to all services, whether delivered in person, online, via telephone, video conferencing, or any other medium, including but not limited to: 1:1 energy healing sessions, psychic mentoring, intuitive readings, mentoring containers, group programs, workshops, retreats, live events, digital products, and online courses.
1.3 These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, including the Australian Consumer Law (ACL) as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
1.4 We may update these Terms from time to time. The version in force at the time you make a purchase or booking is the version that applies to your agreement.
1.5 If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be treated as severable and will not affect the validity or enforceability of the remaining provisions.
In these Terms, the following definitions apply:
"Services" means all services, programs, products, events, courses, workshops, retreats, digital downloads, recordings, and any other offerings provided by Charlotte Beswick.
"Session" means any single appointment, healing session, reading, mentoring call, or class delivered as part of the Services.
"Program" means any multi-session or subscription-based service package with a defined duration, including but not limited to mentoring containers, healing programs, and online courses.
"Program Fee" means the total fee payable for a Program, whether paid in full or by way of a payment plan.
"Payment Plan" means an agreed arrangement to pay a Program Fee in instalments over a defined period.
"Commencement Date" means the date on which the Client first accesses or uses any part of the Services after payment.
"Digital Products" means any downloadable or online content including recordings, e-books, meditations, courses, and worksheets.
"Confidential Information" means any information disclosed in the course of the Services, including client disclosures, session content, and proprietary methodologies.
3.1 A binding contract is formed when you complete a purchase, sign an enrolment form, or make any payment (including a deposit) for Services, whichever occurs first.
3.2 By proceeding with a purchase or booking, you confirm that:
You are at least 18 years of age;
You have the legal capacity to enter into a binding contract;
You have read, understood, and agree to these Terms in their entirety;
All information you have provided to us is accurate and complete.
3.3 No person under the age of 18 years may purchase or participate in any Services. Where a minor participates with our express consent, a parent or legal guardian must sign these Terms on the minor's behalf and assumes full legal responsibility.
3.4 Our acceptance of your order is confirmed by email. That email confirmation constitutes our agreement and no oral or informal representations shall vary or override these Terms.
4.1 All prices are listed in Australian Dollars (AUD) and are inclusive of any applicable taxes, unless otherwise stated.
4.2 Prices are subject to change at any time without notice, provided that any change will not affect a confirmed booking or purchase already made.
4.3 Charlotte Beswick reserves the right to offer discounts, promotional pricing, or early-bird rates at its sole discretion. Such offers are time-limited and subject to availability.
4.4 International clients are solely responsible for any currency conversion fees, bank charges, duties, or taxes applicable in their country of residence. Charlotte Beswick accepts no responsibility for any additional charges imposed by third parties.
4.5 Where a deposit is required to secure a booking, the deposit is non-refundable and will be deducted from the total Program Fee.
This section constitutes the core financial commitment of your agreement. Please read it carefully before proceeding.
5.1 Full Commitment to Payment Plans
Where you elect to pay for a Program by way of a Payment Plan, you acknowledge and agree that:
A Payment Plan is not a subscription that can be cancelled at will — it is a payment arrangement for a fixed-term, fixed-price commitment;
You are committing to the full Program Fee regardless of whether you choose to continue participating in the Program;
The Payment Plan instalments will be charged automatically on the agreed dates using your nominated payment method;
Your obligation to make all scheduled payments remains in force whether or not you attend, access, or engage with the Services;
Ceasing to participate in the Program does not extinguish your obligation to complete all remaining payments.
5.2 Failed or Missed Payments
5.2.1 In the event of a failed or missed payment, Charlotte Beswick will:
Make reasonable attempts to contact you via email and/or telephone within 48 hours of the failed payment;
Suspend access to all Services, sessions, course materials, and digital platforms within 48 hours of the missed payment date;
Apply an administrative fee of AUD $50.00 per failed payment attempt to cover processing costs.
5.2.2 Suspended access will be reinstated only once all outstanding amounts (including any administrative fees) are paid in full.
5.2.3 If payment is not received within 14 days of the due date, Charlotte Beswick reserves the right to:
Refer the outstanding debt to a third-party debt recovery agent;
Commence legal proceedings to recover the full outstanding Program Fee, together with interest at the rate of 10% per annum calculated from the payment due date;
Recover all reasonable legal costs and debt collection costs incurred in enforcing this agreement.
5.2.4 You expressly authorise Charlotte Beswick to retain your payment details and to process any overdue amounts once your payment method is updated.
5.3 Payment Methods
Charlotte Beswick accepts payment via credit card, debit card, direct bank transfer, and such other methods as may be notified from time to time. By providing your payment details, you authorise Charlotte Beswick (or its authorised payment processors) to charge the agreed amounts on the scheduled dates.
Charlotte Beswick does not offer refunds for change of mind, personal circumstances, or a decision not to continue with the Program or Healing. Please review this policy carefully before purchasing.
6.1 No Refund Policy — Programs, Mentoring Containers or Healing Sessions
6.1.1 All Program Fees and deposits paid for mentoring containers, coaching programs, and multi-session packages are strictly non-refundable once the Commencement Date has passed.
6.1.2 This policy applies regardless of the reason for discontinuation, including but not limited to: personal circumstances, relationship breakdown, financial hardship, relocation, illness (other than as specified in clause 6.3), or dissatisfaction with the results of the Services.
6.1.3 The non-refundable nature of Program Fees reflects the significant preparation, energy, resources, and time committed by Charlotte Beswick in advance of and during the Program delivery.
6.2 Individual Mentoring and Healing Sessions
6.2.1 Once payment is received a booking for any healing or mentoring services cannot be cancelled, refunded or transferred to someone else. If the session is within a 48 hour window it can be rescheduled for a later date.
6.2.2 Reschedules made with less than 48 hours' notice will forfeit the full session fee, which will not be refundable or transferable. 6.2.3 A no-show (failure to attend without notice) will result in forfeiture of the full session fee.
6.2.4 Charlotte Beswick reserves the right to reschedule a session due to unforeseen circumstances. In such cases, you will be offered an alternative time at no additional cost.
6.2.5 Charlotte Beswick reserves the right to convert any scheduled in-person session to a virtual format delivered via video conferencing or online platform in the event of unforeseen circumstances. This includes, but is not limited to, global health emergencies, pandemics, government-mandated restrictions or lockdowns, venue closures, natural disasters, or any other circumstance beyond Charlotte Beswick's reasonable control. In such circumstances, the conversion to a virtual format does not constitute a cancellation and no refund, credit, or fee reduction will apply. The virtual event will be deemed to fulfil Charlotte Beswick's obligations in respect of that event in full. Where Charlotte Beswick determines that a virtual format is not a suitable or practicable alternative, a rescheduled in-person date will be offered where possible.
6.3 Extraordinary Circumstances
6.3.1 In the event of genuine and documented extraordinary circumstances (including a serious medical emergency affecting you directly, or the death of an immediate family member), Charlotte Beswick may, at its sole discretion, offer a partial credit, session deferral, or payment pause. This discretion will not be exercised lightly and does not constitute an obligation to provide a refund.
6.3.2 A request under this clause must be made in writing to [email protected] within 14 days of the relevant event and must be accompanied by supporting documentation (such as a medical certificate or death certificate).
6.4 Australian Consumer Law
Nothing in this clause limits or excludes any rights you may have under the Australian Consumer Law, including your rights in relation to services not rendered with due care and skill. If you believe you have a valid claim under the ACL, please contact us directly.
6.5 Digital Products
Digital products (including downloadable recordings, e-books, meditations, and online courses) are non-refundable once they have been accessed, downloaded, or delivered to you.
6.6 Events and Retreats
6.6.1 Tickets to in-person events, workshops, and retreats are non-transferable and non-refundable unless Charlotte Beswick cancels or materially changes the event.
6.6.2 If Charlotte Beswick cancels an event, you will be offered a credit or the choice to attend a rescheduled date. A refund will only be provided if no suitable alternative can be offered.
6.6.3 Charlotte Beswick strongly recommends that you arrange appropriate travel and event cancellation insurance.
6.6.4 Charlotte Beswick reserves the right to convert any scheduled in-person event, workshop, or retreat to a virtual format delivered via video conferencing or online platform in the event of unforeseen circumstances. This includes, but is not limited to, global health emergencies, pandemics, government-mandated restrictions or lockdowns, venue closures, natural disasters, or any other circumstance beyond Charlotte Beswick's reasonable control. In such circumstances, the conversion to a virtual format does not constitute a cancellation and no refund, credit, or fee reduction will apply. The virtual event will be deemed to fulfil Charlotte Beswick's obligations in respect of that event in full. Where Charlotte Beswick determines that a virtual format is not a suitable or practicable alternative, a rescheduled in-person date will be offered where possible.
7.1 You acknowledge that the outcomes of the Services depend significantly on your own active engagement, effort, willingness to participate, and commitment to the process.
7.2 Charlotte Beswick does not guarantee specific outcomes, results, income levels, relationship outcomes, emotional states, or any other particular result from participation in the Services.
7.3 You agree to:
Attend sessions as scheduled and provide reasonable notice of any need to reschedule;
Complete any agreed activities, reflections, or practices between sessions in good faith;
Engage with the Services with an open mind and honest communication;
Notify Charlotte Beswick of any changes to your health, circumstances, or needs that may affect your participation.
7.4 Charlotte Beswick reserves the right to terminate a Program in the event of behaviour that is abusive, threatening, disrespectful, or otherwise harmful to Charlotte Beswick or any third party. In such circumstances, no refund will be payable for the remaining portion of the Program.
7.5 Session rescheduling is subject to availability. Sessions forfeited due to a client's failure to attend or provide adequate notice cannot be carried forward unless Charlotte Beswick agrees in writing.
Charlotte Beswick is not a licensed medical or mental health professional. The Services are complementary and holistic in nature and do not constitute medical, psychological, psychiatric, or therapeutic advice or treatment.
8.1 You acknowledge that:
The Services offered by Charlotte Beswick are spiritual, holistic, and energetic in nature;
The Services are not a substitute for professional medical, psychological, psychiatric, legal, financial, or nutritional advice;
You should consult a qualified healthcare professional before commencing any healing or wellness program, particularly if you have an existing physical or mental health condition;
Any changes to your health, medication, or treatment plan should be made only under the supervision of a qualified medical professional.
8.2 You warrant that you have disclosed all relevant health information to Charlotte Beswick prior to commencing the Services and that you will notify us of any changes to your health throughout the program.
8.3 Charlotte Beswick accepts no responsibility for any adverse physical, psychological, emotional, or spiritual outcomes arising from participation in the Services, including outcomes arising from your failure to follow the guidance in this clause.
8.4 Embody Her — Breathwork and Somatic Practices Contraindications
Where the Services, including those delivered within the Embody Her mentoring container, include breathwork, somatic, or body-based practices, you confirm that you do NOT have any of the following conditions (or if you do, you have received written medical clearance and informed us prior to commencing):
● Pregnancy
● Cardiovascular disease, angina, or a history of heart attack
● High blood pressure
● Glaucoma or retinal detachment
● Osteoporosis
● Recent injury or surgery
● History of severe panic attacks, psychosis
● Severe mental illnesses
● Seizure disorders
● Family history of aneurysms
● Hospitalisation for any psychiatric condition, emotional crisis, spiritual emergence within the past 3 years
● Any other medical, psychiatric or physical conditions that would impair or affect your ability to engage in activities involving intense physical and/or emotional release.

8.5 Mental Health and Crisis Support

9.1 Charlotte Beswick will keep all personal information shared during the course of the Services strictly confidential and will not disclose it to any third party without your express consent, except where required by law.
9.2 You agree to keep confidential any proprietary frameworks, methodologies, materials, and content shared with you during the Services. You may not share, reproduce, or distribute such content without our written consent.
9.3 Charlotte Beswick may share anonymised or de-identified information for testimonial or marketing purposes only with your prior written consent. You may withdraw this consent at any time by contacting us in writing.
9.4 We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, available at charlottebeswick.com. By engaging our Services, you consent to the collection and use of your personal information for the purposes of delivering the Services and communicating with you.
9.5 You agree to maintain the confidentiality of any other clients or participants whose information you may become aware of in the context of group programs or events.
10.1 All content, materials, frameworks, methodologies, recordings, course materials, worksheets, videos, audio files, and written materials provided as part of the Services are the exclusive intellectual property of Charlotte Beswick and are protected by copyright under the Copyright Act 1968 (Cth).
10.2 Your purchase of or participation in the Services grants you a personal, non-exclusive, non-transferable licence to access and use the materials solely for your own personal development. You may not:
Copy, reproduce, republish, upload, post, transmit, or distribute any materials;
Share, sell, sublicense, or otherwise provide access to any materials to any third party;
Use any materials for commercial purposes without our express written consent;
Remove or alter any copyright notices or proprietary markings.
10.3 Any breach of this clause may result in immediate termination of your access to the Services without refund and may expose you to legal liability.
10.4 The name "Charlotte Beswick," all associated brand names, logos, taglines, and proprietary frameworks (including The Energy Kink Method™ and any other named methodologies) are the exclusive property of Charlotte Beswick and may not be used without written permission.
11.1 To the maximum extent permitted by law, Charlotte Beswick's total liability to you for any loss, damage, or claim arising out of or in connection with the Services (whether in contract, tort, or otherwise) is limited to the total amount paid by you for the specific Service giving rise to the claim.
11.2 Charlotte Beswick expressly excludes liability for:
Any indirect, special, incidental, consequential, or punitive loss or damage;
Loss of profits, revenue, business opportunity, or data;
Any emotional, psychological, physical, or spiritual outcomes arising from participation in the Services;
Any reliance you place on information, insights, or guidance provided during the Services;
Any third-party services, products, or platforms referenced or recommended in the course of the Services.
11.3 Charlotte Beswick does not warrant that the Services will be uninterrupted, error-free, or free from technical issues. In the event of a technical failure beyond our reasonable control, we will make reasonable efforts to reschedule affected sessions.
11.4 Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Australian Consumer Law that cannot be lawfully excluded.
12.1 Any testimonials, case studies, or examples of results shared by Charlotte Beswick are illustrative only and reflect individual experiences. They do not constitute a guarantee, promise, or representation that you will achieve similar results.
12.2 Individual results will vary depending on a wide range of personal factors including, without limitation, effort, commitment, prior experience, health status, personal circumstances, and readiness for change.
12.3 Charlotte Beswick makes no representation or warranty regarding the accuracy, completeness, or suitability of any information provided during the Services for your specific situation.
13.1 By engaging our Services or purchasing from our website, you consent to receive communications from Charlotte Beswick via email, SMS, WhatsApp, or such other platform as may be agreed. You may unsubscribe from marketing communications at any time, but operational communications relating to your Services will continue.
13.2 Written communications (including email, SMS, and messaging platform messages) are binding in the same way as written correspondence signed by both parties.
13.3 All formal notices under these Terms must be provided in writing to [email protected] and will be deemed received on the next business day following sending.
13.4 You are responsible for ensuring that the contact details you provide to us are current and accurate. Charlotte Beswick accepts no liability for any failure to receive communications resulting from inaccurate contact information.
14.1 In the event of any dispute arising out of or in connection with these Terms or the Services, both parties agree to first attempt to resolve the dispute in good faith through direct communication.
14.2 If the dispute cannot be resolved through direct communication within 21 days, the parties agree to attempt mediation through a mutually agreed mediator before commencing any legal proceedings.
14.3 If mediation is unsuccessful or not agreed, either party may refer the dispute to the courts of Western Australia, which will have non-exclusive jurisdiction over any proceedings.
14.4 Nothing in this clause prevents Charlotte Beswick from seeking urgent interlocutory or injunctive relief in any court of competent jurisdiction.
14.5 In the event that Charlotte Beswick is required to enforce these Terms through legal proceedings or debt recovery, you agree to be liable for all reasonable legal costs and expenses incurred by Charlotte Beswick on a solicitor-client basis.
15.1 Charlotte Beswick will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of God, pandemic or epidemic, government restrictions, illness, internet or technology outages, or any other event outside our reasonable control.
15.2 In such circumstances, Charlotte Beswick will notify you as soon as practicable and will make reasonable efforts to reschedule or fulfil its obligations as soon as circumstances allow.
16.1 Client-Initiated Conversion to Virtual Session
Where a Client is unable to attend a scheduled in-person Session due to illness, personal circumstances, or any other reason, Charlotte Beswick may, at its sole discretion, offer to convert that Session to an equivalent virtual session delivered via video conferencing. Such a conversion does not constitute a cancellation and no refund, credit, or fee reduction will apply. The converted virtual session will be deemed to fulfil Charlotte Beswick's obligations in respect of that Session in full. This option is offered as a courtesy and is subject to availability; it does not create an ongoing obligation on Charlotte Beswick to offer virtual alternatives in future.
16.2 Charlotte Beswick-Initiated Conversion to Virtual Session
Charlotte Beswick reserves the right to convert any scheduled in-person Session to an equivalent virtual session delivered via video conferencing, where circumstances require. Charlotte Beswick will provide reasonable notice of any such change where possible. A virtual session delivered in these circumstances will be of equivalent duration and content to the originally scheduled in-person Session and will fully satisfy Charlotte Beswick's obligations in respect of that Session. No cancellation, refund, credit, or fee reduction will apply as a result of this change.
16.3 Technical Requirements for Virtual Sessions
Where a Session is delivered virtually, the Client is responsible for ensuring they have a stable internet connection, appropriate device, and access to the agreed video conferencing platform. Charlotte Beswick accepts no liability for any disruption caused by the Client's technical difficulties. Where a virtual session is materially disrupted due to Charlotte Beswick's technical failure, a replacement session will be offered at no additional cost.
16.4 Conversion Due to Unforeseen Circumstances, Government Restrictions or Global Events
Charlotte Beswick reserves the right to convert any scheduled in-person Session to a virtual format in the event of unforeseen circumstances, including but not limited to global health emergencies, pandemics, government-mandated restrictions or lockdowns, natural disasters, or any other event beyond Charlotte Beswick's reasonable control. Such a conversion does not constitute a cancellation and no refund, credit, or fee reduction will apply. The virtual session will be deemed to fulfil Charlotte Beswick's obligations in respect of that Session in full. Where a virtual format is not a suitable or practicable alternative, a rescheduled in-person date will be offered where possible.
The following terms apply specifically to the Embody Her mentoring container and the retreat experience included as a complimentary bonus within that program.
17.1 Certain mentoring containers offered by Charlotte Beswick, including the Embody Her program, include access to a retreat experience as a complimentary bonus (the "Retreat Bonus"). The Retreat Bonus is provided at no additional cost and does not form part of the core Services for which the Program Fee is charged. It is an added-value gift offered at the absolute discretion of Charlotte Beswick.
17.2 Charlotte Beswick reserves the right to cancel, reschedule, change the format, location, date, duration, or content of the Retreat Bonus at any time and for any reason, including but not limited to: insufficient participant numbers, venue unavailability, illness, family circumstances, force majeure events, or any other circumstance within or outside Charlotte Beswick's reasonable control.
17.2.1 Without limiting the above, Charlotte Beswick reserves the right to convert the Retreat Bonus from an in-person format to a virtual format in the event of unforeseen circumstances, including but not limited to global health emergencies, pandemics, government-mandated restrictions or lockdowns, venue closures, natural disasters, or any other event beyond Charlotte Beswick's reasonable control. Such a conversion does not constitute a cancellation and will not entitle the Client to any refund, credit, or reduction of any Program Fee.
17.3 Any such cancellation, rescheduling, or variation of the Retreat Bonus does not constitute a breach of contract and will not entitle the Client to a refund, credit, partial refund, or reduction of any Program Fee, whether in whole or in part. The Client's obligation to complete all scheduled Program Fee payments remains unaffected by any change to or cancellation of the Retreat Bonus.
17.4 Where possible, Charlotte Beswick will endeavour to offer an alternative date or format for the Retreat Bonus, but accepts no legal obligation to do so. The non-delivery of the Retreat Bonus in any form does not constitute a failure to deliver the Services for which the Program Fee was paid.
17.5 The Client acknowledges and agrees that in enrolling in the Embody Her program, their primary commitment is to the core mentoring and healing Services, and that the Retreat Bonus is offered as a gift of additional value only.
18.1 These Terms constitute the entire agreement between you and Charlotte Beswick with respect to the Services and supersede all prior representations, negotiations, and agreements.
18.2 No variation to these Terms will be valid unless agreed in writing by both parties.
18.3 Charlotte Beswick's failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or any future right to enforce it.
18.4 You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent.
18.5 These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

By agreeing, you confirm that you have read these Terms and Conditions in full, that you understand and agree to be legally bound by them, and that you enter into this agreement freely and voluntarily.
